Telephone Consumer Protection Act Compliance

This policy outlines how Modern Mortgage, along with our affiliates, partners, and service providers (collectively, "we," "us," or "our"), communicates with you and how we comply with the Telephone Consumer Protection Act ("TCPA"). This policy is a supplement to our general Privacy Policy and Terms of Service.

1. Express Written Consent and Scope of Communication

Important: By submitting your information and providing your phone number on our website forms, you are providing your express written consent to be contacted by us, our affiliates, and our third-party partners.

You agree to receive communications, including calls, text messages, and emails, to the phone number(s) you have provided. This consent covers contact for purposes of:

  • Marketing and promotional communications
  • Lead generation and follow-up
  • Loan application status updates
  • General customer service
  • Mortgage-related information and services

You acknowledge that this communication may be generated using an automatic telephone dialing system (ATDS), an artificial voice, or a prerecorded voice, even if your phone number is on a national, state, or company-specific Do-Not-Call list.

You understand and agree that standard message and data rates may apply to any text messages you send to or receive from us, depending on your mobile carrier's plan. We are not responsible for any charges incurred as a result of receiving text messages from us.

6. User's Representation and Contact Information

By providing a phone number, you represent that you are the true owner and authorized user of the number. You agree to indemnify us for any claims, costs, or damages arising from your failure to provide accurate contact information.
